Jurors took less than an hour to conclude that Trudeau had violated a 2004 settlement with the FTC that prohibited him from making false weight-loss claims on TV infomercials. Prosecutors said Trudeau knowingly marketed his book, “The Weight Loss Cure ‘They’ Don’t Want You To Know About,” in TV infomercials in 2006 and 2007 in blatant violation of his 2004 FTC agreement. Those late-night infomercials have aired over 32,000 times since then. In his book, Kevin, 50, touted an obesity “cure” that included a 500-calorie-a-day diet and the use of prescription hormones. At trial, his attorney argued that Trudeau’s claims were constitutionally-protected free speech under the First Amendment. Prosecutors (and jurors) did not buy the defense. In 2010, a federal judge ordered Trudeau to pay consumers $38 million after finding the weight-loss claims he had made in his books were grossly exaggerated or just plain bogus.
